What is alternative dispute resolution (ADR)?
ADR encompasses a number of processes used to resolve conflict, including mediation, arbitration, settlement conferences, evaluations and negotiations. Most often ADR is a private, voluntary process undertaken by individuals in conflict who, aided by a mediator, come together to discuss and attempt to resolve their dispute without going to court.
What is the mediator’s role?
Ideally, a good mediator remains neutral, fair and focused on activities most productive to reaching resolution. This includes providing a structured, equal environment where both parties may express their side, ensuring the process remains respectful and productive, obtaining and evaluating information from all parties and, when necessary, impartially applying the law—all in an effort to discover a solution to which both parties can agree.

Utilizing ADR as a tool for conflict is often less expensive than obtaining legal counsel and taking the matter to court. In addition, it allows the parties to resolve the conflict—and move on with their lives—much sooner than would be possible through litigation. Because ADR is usually a voluntary decision rather than a court-mandated requirement, the parties retain control over the outcome of the dispute, including whether they accept any proposed solution.
